A Notary’s duty is to screen the signers of important documents for their true identity, their willingness to sign without duress or intimidation, and their awareness of the contents of the document or transaction. Some notarizations also require the Notary to put the signer under an oath, declaring under penalty of perjury that the information contained in a document is true and correct. Property deeds, wills, powers of attorney, parent consent forms and vin-verification forms are examples of documents that commonly require a Notary.

  • If signer is not physically present at the time of appointment.
  • If the document is incomplete or blank.
  • If the Notary has reason to believe the signer appears to be confused, disoriented or lacks the mental capacity to sign documents.
  • If the signer cannot produce acceptable identification; and/or the signer cannot produce “Two Credible Witnesses,” to identify the signer.
  • If the signer appears to be drunk, sedated, or disoriented.
  • If the notary knows or suspects that the transaction is illegal, false, or deceptive.
  • If the signer does not speak the same language as the Notary and there is no one to translate.
  • If the notary believes that the signer is being coerced or does not understand the consequences of signing the document.
  • If the signer or witnesses do not agree to signing the document.

Beach Life Notary will make every reasonable accommodation to provide notarial services to persons with disabilities.

We may notarize the signature of a person who is blind after we have read the entire instrument to that person

The best way to handle this situation, and reduce the risk of miscommunication  is for us to communicate with person by writing notes.

In this situation, we are able to notarize the signature of a person who signs with a mark if:

  • The document signing is witnessed by two disinterested persons; and
  • We will print the person’s first name at the beginning of the designated signature line
    and the person’s last name at the end of the designated signature line; and
  • Print the words ‘his (or her) mark’ below the person’s signature mark

 As a Notary Public, we are able to sign the name of the person whose signature is to be notarized when that person is physically unable to sign or make a signature mark on a document if:

  • The person with a disability directs the notary public to sign in his or her presence by verbal,
    written, or other means;
  • The document signing is witnessed by two disinterested persons; and
  • The notary public writes below the signature the following statement: ‘Signature affixed by notary’. 

“A notary public may not take the acknowledgment of a person who does not speak or understand the
English language, unless the nature and effect of the instrument to be notarized is translated into a
language which the person does understand”

Note: An oral translation is sufficient.  The notary public may not translate the document.
